I really hate conspiracy theories, but you really have to question the motives of the FCC when it comes to Sirius XM Radio (Nasdaq: SIRI). It took the agency nearly 17 months to approve the merger of the two satellite radio providers, which nearly resulted in bankruptcy for the newly combined company. On March 4th, the FCC granted special temporary authority for Sirius to broadcast in Haiti for 30 days to assist in relief efforts, following the devastating earthquake which occurred in Mid-January. Now it appears that the FCC, after years of legal wranglings, is going to recommend the approval of certain wireless services in the spectrum adjacent to Satellite Radio — services that it willingly admits will cause devastating interference to Satellite Radio. Enough is enough!
Sirius XM operates its satellite radio service in the 2320-2345 MHz range. The cost of this spectrum was approximately 170 million dollars. Both Sirius and XM then spent billions of dollars to create a service which is now consumed by 35 million people in the U.S. Along the way, the FCC auctioned spectrum on both ends of the Satellite Radio spectrum, with the express condition that the services allowed could not interfere with the SDARS service. The FCC forthrightly and unequivocally stated that protecting Satellite Radio may “make mobile operations in the WCS spectrum technologically infeasible.” As a result, the entire WCS spectrum was auctioned for only 14 million dollars.
As wireless carriers become desperate for increased bandwidth, they are seeking to broaden their use of the space beyond that of which it was intended to be used for. Testing has confirmed beyond any doubt that interference to the SDARS service will occur. Common sense would dictate that such a scheme by the wireless carriers would be denied. Unfortunately, it seems that the FCC is about to propose a plan to allow just this to happen. The only recourse for Sirius XM would be to file complaints as issues occur, to be remedied after the fact and through unknown means. Any complaints will no doubt take years to resolve, taken on an individual basis.
In a letter to FCC Chairman Genechowski, Sirius XM CEO Mel Karmazin writes:
We are extremely disturbed by the proposal. The proposed rules seem to bear little resemblance to the technical record in this proceeding. More importantly, the proposal raises the real and direct threat of crippling interference to our 35 million current listeners and the 90 million satellite radio-equipped vehicles that will share the road with mobile WCS by 2015.
- We were told bluntly that the staff proposal would enable the deployment of WCS “usage models” that would cause interference to satellite radio consumers.
- The staff proposal for WCS mobile transmitters in the C and D blocks – the blocks immediately adjacent to our satellites – would double the power levels the WCS licensees themselves asked for, and would exceed the levels the WCS licensees themselves demonstrated in Ashburn, Virginia.
We were told not to worry that the relaxed WCS technical standards might cause interference to satellite radio, because WCS licensees would bear the ultimate responsibility to avoid interference.
The staff offered no details about any sort of coordination or complaint process that would identify and eliminate sources of interference created by WCS networks and particularly mobile transmitters. This entire process presumes that consumers would complain instead of just discontinuing their subscriptions. Any such cumbersome, after-the-fact system would not work to protect consumers and would place the Commission in the impossible role of policing interference to all of our subscribers.
If this outrage were to occur, I would suggest that Sirius XM offer to allocate its bandwidth directly adjacent to the WCS spectrum, for its FCC mandated,”voluntary” minority channel set aside. I’m sure the FCC would think twice at that point, knowing the space that was purchased with certain rights of protection would be rendered basically useless.
This is a call to arms! If you are Sirius XM subscriber, listener, investor, or just a concerned American over the abuse of government, you need to act and act now. Tell the FCC how you feel about this abuse of government. Let them know that you will vote according to their actions. You can submit your opposition here. And no matter how much your girlfriend the NAB and your mistress the wireless carriers say they’ll run ads to get you reelected, no one listens to that garbage anymore. What you’re doing is wrong. As an investor in Sirius XM I am appalled at the thought that government can do whatever they want. Creating competition is good for this country. Also BM, I know hindsight is 20/20 – but couldn’t sirius and xm just have purchased the bandwidth at a super cheap price adjacent to theirs just to protect their powerful bandwidth? I understand the FCC guaranteed that no interference would occur, but were they able to purchase that “useless” bandwidth when it was up for auction?

feel this is all postering, and its still . , concensions will be made, and asking for more than even the other entities asked for is purely a ploy to see what they will be able to get away with. Obviously in court, this new recommendation has no teeth, no legs, and will never come to pass as mentioned.
Its time to hire a high-powered attorney and sue the DOJ and FCC for attempting to destroy Satellite Radio. Enough is enough.
We i am sure will have the same problem with over the air TV. CHhannels over 51 were sold to wirless and having a transmitter close to a tv antenna can overload the tv so that it stops working. The FCC in years past knew what they were doing and now they have no idea or do not care about what they do. The digital (atsc)that was forced on us has caused millions of people to loose over the air tv. UIt now looks like the new mobile tv as it is called is causing many new tv’s to lock up to were they need to be unpluged a half hour to reset. Our Government has run amuck with everything.

It has been proven beyond doubt that you can’t reason with these dunkleberry thickheaded misanthropes; resort to a higher power (the federal administrative courts) is pretty much a given.

XM Satellite Radio and WCS Wireless have announced the termination of their agreement for XM to acquire WCS Wireless.
At the time of the acquisition agreement between XM and WCS Wireless, announced about a year ago, the two companies had expected to close their transaction by this time. But despite both XM’s and WCS’ efforts to obtain government approval, it has not been forthcoming to date. The NAB strongly opposed the XM/WCS deal, and worked very hard to block federal approval.
As a result, XM and WCS Wireless have agreed to terminate the acquisition agreement in order to free WCS Wireless to pursue other alternatives for its spectrum licenses.
In commenting on the termination, Gary Parsons, Chairman of XM, stated, “With the inability to obtain the necessary government approval for this transaction in a timely manner, WCS Wireless needed to pursue alternatives for its spectrum with greater certainty of regulatory approval.”
It was widely speculated that the acquisition of WCS Wireless would provide XM the bandwidth to broadcast additional satellite radio services such as video, giving way for devices like the XM Satellite Video Player. Whether or not this halts the satellite video project altogether is unknown, but XM did indicate that they would be able to provide these additional satellite services even if the WCS acquisition didn’t go through.

Docket number 07-293, I urge you to revisit the the issuance of bandwith for wireless carriers as it would interfere with certain broadcast channels and programming of Sat Radio. Sirius has done everything by the books the create a new market, including capital investment to create this new for of broadcast, and you are passively issuing conflicting bandwith to large corporate america in the form of cell phone companies, instead of doing the right thing and denying their request and making them invest the capital that Americans companys do to be successful. If the merger wasn’t suspicious enough, this clearly wreaks of corruption and lobbyist influence as usual. STOP THE POLITICS AND DO YOUR JOB FAIRLY AND WITHOUT BIAS, LOBBYING, OR INFLUENCE. Sirius has done it the right way, now stop being influenced by large corporations and employ the truth and justice that Americans deserve.
Will it never end? I am in Spain on vacation but took the time to protest. It was not easy to manuever the FCC website. I could not comment directly but had to create a file. Not sure it all worked. But this is asinine. No question there are many who want strong censorship.
In addition to submitting a comment to the FCC, I submitted one to the White House as well. The FCC is violating their mandate if they do this. Who else is there to complain to?

I think it is an extremely serious matter that warrants a “full court” legal response by Sirius XM and Liberty (as their 40% equity position in Sirius XM makes them a fully involved participant.) Both parties – along with their venture partners in the auto industry – should definitely pull out all stops to make their views known throughout the legislative and executive branches of the government. The FCC should not be allowed to trample on previously negotiated understandings and agreements in this way.
Is there any possibility Sirius can sell the bandwidth it does not need. Could this be a blessing ?

Instead they will cancel subscriptions until, if ever, the problem is remedied. I am totally opposed to letting leases on the WCS C and D blocks. It is so difficult to believe that you will allow wireless to destroy something that has taken years and billtions of dollars to establish. You need to understand that this is the death of a complete TAXPAYING industry that you are proposing. This must cease or billions upon billions will be lost.

Concerning docket 07-293. I find the decision to boost WCS levels on the bands adjacent to satellite radio (and effectively degrading it) unconscionable. As an engineer it offends me, as a consumer it offends me, and as an American, it offends me. The 35 million satellite radio subscribers will have the last word if this carries through. This course of action is both technically unsound and a swipe at American ideals.
As an engineer I find it amazing that the FCC is manned by so many technically incompetent people. They appear to be unable to understand the issue of signal “inteference”. If they claim to be ex high level managers – then I only need to point to the economy and how they handled the SXM merger as validation that they were and are not good at that either. This isn’t even a good political move. So what they have on their mind is bewildering.
Although I am not an attorney – maybe there are grounds for a Sirius customer class action suit. Would be good if any of our legal friends could comment. Filing my complaint today.
Hey Brandon, can you post your Price/Percentage chart again. I’d like to see when the next bump up might be. In addition, maybe the low range spec., i’m guessing around .80.
Unless a really positive article comes out in the next few weeks, I think the next catalyst will be the April 3rd date. I hope that they go ahead and retire the 500mil they moved up, my guess is yes.

I just filed my complaint for the provided docket number. Take a look at the first few filings from the major parties on this issue. It’ll give a good perspective of what is being fought for.
Click on the link provided. Find the docket number and click on the “i” link. On the top, click on the “Search For Comments in 07-293″ link. Click on “Last”.
So far, 150 comments have been submitted since this article was published. It has had over 10,000 hits. We need to do better than that.

Due to this binding clause SIRIUS-XM IS growing, is employing thousands of Americans and created a whole new industry where others feared to invest in. Now, acting like the vermin of decadent cronyism that keeps 3rd world economies exactly where they are, you are about to disregard what you already received dues to protect.
Now, what we tax-paying-common-sense-law-abiding Americans want to know is, who is bribing you? By how much are you willing to undermine America’s entrepreneurship and remove yet more trust from the system in place? And do you think it will remain unknown for long?”"
